A Bed and Breakfast is “a lodging or rooming house as defined in Public Safety Article, §9-201, Annotated Code of Maryland, that has eight rooms or fewer for rent” as defined in the Code of Maryland Regulations (COMAR) 10.15.03.02(8). A Bed and Breakfast operation that serves only a Continental Breakfast is not required to obtain a food service facility license. Continental Breakfast means a meal that does not require major food preparation and is limited to foods as specified in COMAR 10.15.03.02.16(b). Bed and Breakfast operations that serve food beyond the scope of a Continental Breakfast must obtain a food service facility license. New or Remodeled Bed and Breakfast Food Service Facilities
In order to open a new Bed and Breakfast food service facility or for those being remodeled or materially altered, complete plans for the building, including all food preparation equipment, menu and food preparation processes, must be submitted to the Anne Arundel County Permit Center. Department of Health fees for licensing will be assessed upon receipt of plans. Change of Ownership
A Food Service Facility License is issued to one owner for one location and is not transferable to another owner or location. If you plan to purchase a Bed and Breakfast which is in operation through a change of ownership and offer more than a Continental Breakfast as defined in COMAR 10.16.03.16(b), you must obtain a new Bed and Breakfast Food Service Facility License.
Bed and Breakfast food service facilities are given a high or moderate priority rating. Ratings are based on the type of food served and how the food is prepared.
A high priority facility serves potentially hazardous foods prepared a day or more before being served. These facilities may also use food preparation methods that require the food to pass through the temperature range of 41°F to 135°F two or more times before service, such as cooking, cooling, and reheating.
A moderate priority facility serves potentially hazardous foods prepared using methods that require the food to pass through the temperature range of 41°F to 135°F only once before service, such as cooking, hot holding, and serving. A moderate priority facility may also cut, assemble, or package potentially hazardous foods on the premise.
